Please read the following terms and conditions ("Terms") carefully before using the services provided by BuyBacKart. These Terms constitute a legally binding agreement between you ("Seller", "you", or "your") and BuyBacKart.

1. General Overview

These Terms and Conditions describe how "BuyBacKart," a business operated by BuyBacKart E Waste Solution Pvt Ltd., with its registered office at 115, 1st Floor, DLF Prime Towers, Mata Mohalla, Pocket F, Okhla Phase I, Okhla Industrial Estate, New Delhi-110020, India ("BuyBacKart," "we," "our," or "us"), collects, uses, discloses, and protects the personal information of users ("you" or "user") through our website, mobile application, and related services. Our online services commenced in 2020, and we currently operate across more than 22 cities in India.

By accessing, browsing, or using any of our services, including but not limited to our official website, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy (available separately on our website). If you do not agree to these terms, you must not use our services.

2. Seller Obligations and Representations

2.1. Legal Competence and Age: The Seller must be a natural person aged 18 years or older or a legal entity duly incorporated and authorised to enter into binding agreements under Indian law.

2.2. Identity Verification: The Seller must present a valid, government-issued identification document (e.g., Aadhaar Card, Passport, Voter ID Card, or, in the case of a business, relevant incorporation documents and authorised signatory details) at the time of transaction.

2.3. Lawful Ownership and Origin of Device:

• The Seller represents that they are the lawful owner of the electronic device, or authorised by the legal owner to sell it.
• The device must be legally acquired and not obtained through theft, fraud, cloning, misappropriation, or other illegal activity.
• The device must have been originally purchased in India.
• Seller remains solely responsible for legal consequences arising from false ownership or illegal origin.

2.4. Data Deletion: The Seller is solely responsible for backing up and permanently deleting all personal, sensitive, and confidential data from the device before handover.

2.5. Device Condition and Description Accuracy: The electronic device must match the condition described during quotation. Any discrepancy may lead to revised offer or cancellation.

3. Inspection, Pickup, and Acceptance

3.1. Right to Inspect: BuyBacKart may inspect, test, and verify the device at any stage including before pickup, during pickup, and after pickup.

3.2. Consequences of Defects or Discrepancies:

• Transaction may be cancelled if mismatch or irregularity is detected.
• If payment was made, BuyBacKart may reclaim full purchase amount from Seller.
• BuyBacKart may recover losses including transport, inspection, handling, storage and legal costs.

3.3. Pickup Protocol:

• Seller or authorised representative must be physically present at handover.
• Device must be handed only to verified BuyBacKart employee or authorised representative.
• BuyBacKart is not liable for handover to unauthorised persons.
• Original purchase invoice or valid ownership proof must be provided at pickup.

4. Payment Terms

4.1. Mode of Payment: Payment is processed only to verified bank account of legal owner or authorised seller. Cash payments are generally avoided for security and compliance.

4.2. Revocation/Cancellation of Payment: Payment is conditional upon legitimacy and accurate description of device.

4.3. Seller Liability for Illegal Products: Seller remains solely liable for fraudulent, illegal, or misrepresented product and must refund amount received plus related costs and damages.

5. Legal Declarations and Indemnification

By initiating a transaction with BuyBacKart and selling your electronic device, you confirm and agree:

• You are legally competent and at least 18 years old.
• All information and documents provided are true and complete.
• You are lawful owner of device with clear title and right to sell the device.
• You indemnify BuyBacKart from claims, liabilities, and losses arising from your breach, misrepresentation, or third-party ownership disputes.
• Device is not stolen, cloned, counterfeit, or unlawfully modified.
• You have permanently deleted personal data and removed SIM/memory cards before handover.
• Device condition is consistent with description and free from undisclosed defects.
• Once accepted by BuyBacKart, device shall not be returned unless explicitly agreed in writing or mandated by court order.
• You consent to service-related communication and transaction updates on provided contact details.
• You enter this agreement voluntarily without coercion, force, or misrepresentation.

6. Miscellaneous Provisions

6.1. Right to Accept/Reject: BuyBacKart may accept or reject any device or cancel any transaction for any reason, including suspected fraud, violation of Terms, or market conditions.

6.2. Suspicious/Fraudulent Transactions: Such transactions may be cancelled immediately and reported to law enforcement authorities.

6.3. Amendments: BuyBacKart may update these terms from time to time. Continued use after updates constitutes acceptance.

6.4. Governing Law and Jurisdiction: These Terms are governed by laws of India. Courts in Delhi, India, have exclusive jurisdiction.

6.5. Severability: If any provision is invalid or unenforceable, remaining provisions remain in full force.

6.6. Force Majeure: BuyBacKart is not liable for delays/failures caused by events beyond reasonable control.

6.7. Entire Agreement: These Terms, together with Privacy Policy, form complete agreement between Seller and BuyBacKart.

7. Indemnity Form (Declaration)

I, the undersigned, declare that I am lawful owner or have legal authority to sell or dispose the listed product through BuyBacKart. I declare product is not stolen, disputed, or under third-party claim. I further undertake to indemnify and hold harmless BuyBacKart, its directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses arising from misrepresentation, ownership disputes, third-party claims, or breach of applicable Indian laws.
