Return, Refund & Cancellation Policy

Scope & Applicability

This Return, Refund, and Cancellation Policy governs all transactions conducted through the BuyBacKart platform. By engaging in a transaction with BuyBacKart, the seller acknowledges and agrees to abide by the terms stated herein.

Return & Refund Conditions

Illegal or unethical sale

If a device is sold to BuyBacKart through illegal, fraudulent, or unethical means, including but not limited to the use of forged documents, stolen property, or misrepresentation of ownership, the seller will be held fully liable for such a transaction.

In such cases:

• BuyBacKart reserves the absolute right to cancel the transaction.
• The seller shall refund the full amount received for the device along with interest at the rate of 24% per annum calculated from the date of payment until the date of refund.
• The seller shall be subject to civil and criminal legal action, including proceedings under the Indian Penal Code (IPC) for cheating, forgery, and criminal breach of trust.
• BuyBacKart shall bear no liability arising from such transactions and shall cooperate fully with law enforcement authorities.

Concealment of facts:

• Cancel the transaction immediately.
• Demand a full refund of any payment made to the seller.
• Initiate recovery and enforcement through appropriate legal channels, including filing a civil recovery suit and/or criminal complaint if necessary.

No other returns:

• Apart from the circumstances described in 2.1 and 2.2, BuyBacKart does not entertain any other return requests for devices sold to the company. All sales are final and binding once accepted after inspection, except as otherwise provided by law.

Cancellation Policy

Before pickup:

• The seller may cancel the transaction at any time before the device is physically delivered to BuyBacKart, without penalty.

After pickup:

• Once BuyBacKart has received the device, any cancellation request will be considered solely at the discretion of BuyBacKart. Approval of cancellation after pickup is exceptional and may be subject to administrative charges.

Legal compliance & jurisdiction

This policy shall be governed by and construed in accordance with the laws of India. All disputes, claims, or legal proceedings arising out of or related to this policy shall be subject to the exclusive jurisdiction of the courts at New Delhi, India. Nothing in this policy limits BuyBacKart's right to pursue legal remedies under the Consumer Protection Act, 2019, the Information Technology Act, 2000, the Indian Contract Act, 1872, and relevant provisions of the Indian Penal Code in cases of fraud, misrepresentation, or breach of contract.

Policy modifications

BuyBacKart reserves the right to revise, amend, or update this policy at any time without prior notice. Any such modifications shall be published on the official BuyBacKart website and shall be binding upon all parties engaging in transactions thereafter.
